DISPUTE RESOLUTION

Such arbitration shall be conducted by a single arbitrator in Fairfax County, Virginia. In arriving at the award, the arbitrator shall make every effort to find a solution to the dispute in the provisions of these Terms of Use and give full effect to all parts hereof.

However, if a solution cannot be found in the provisions of these Terms of Use, the arbitrator shall apply the law of the Commonwealth of Virginia. The arbitrator shall be selected by mutual agreement of You and Assured; if You and Assured cannot agree upon an arbitrator within thirty (30) days, the American Arbitration Association shall appoint an arbitrator as soon as possible, but within thirty (30) days, in accordance with the then-prevailing rules. The arbitrator is not authorized to act as amiable compositeur but shall rule in accordance with the applicable substantive law. The arbitrator shall streamline the procedures while ensuring fairness in order to quickly and cost-effectively resolve the dispute. The award shall be in writing. The arbitrator may award costs and reasonable attorneys’ fees to the prevailing party in accordance with the arbitrator’s judgment of justice and fair play.

CERTAIN LEGAL MATTERS
These Terms of Use are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules, and the laws of the United States of America.

Except as expressly provided in a separate Content between You and Assured, these Terms of Use constitute the entire agreement between You and Us with respect to the use of the Website, the Assured Systems and any software or service, information and content contained therein, and supersede all prior communications, conversations and agreements concerning the matters contained herein.
